Atlona, Inc. (“Atlona”) Limited Product Warranty Policy

Coverage

Atlona warrants its products will substantially perform to their published specifications and will be free from defects in materials and workmanship under normal use, conditions and service for the applicable Warranty Periods set forth below.

Purchaser’s exclusive remedy under this warranty and Atlona’s sole obligation is to either:

    1. Repair the defective products within a reasonable period of time;
    2. Replace the defective products with the same or similar products deemed by Atlona to perform substantially the same function as the original products; or
    3. Refund the depreciated value of the product, in cases where products are beyond repair and/or no direct or substantially similar replacement products exist.

Atlona shall have sole discretion as to which of these remedies Atlona will provide to Purchaser. This Limited Product Warranty extends to the original end-user purchaser (“Purchaser”) of Atlona’s products and is non-transferrable to any subsequent purchaser(s) or owner(s) of these products.

Warranty Periods

The Warranty Period begins on the date of purchase from Atlona or from an Atlona authorized distributor, dealer or reseller by the end-purchaser. The date contained on the end purchaser’s sales receipt/invoice is the proof purchase date. However, the Warranty Period will begin no later than twelve months from the original shipment date from Atlona to the authorized distributor, dealer, reseller or end-user (if direct sale from Atlona).

The following Warranty Periods apply:

    1. Products purchased prior to June 1, 2013
      3 years
    2. B. Products purchased between June 1, 2013- December 31st, 2023
      10 years, except for the products listed in Table 1

      3 years, except for CAP-SP100 Series, AT-VKP-8E/EU, VTP, VTPG, and VSP Series product which have a 2-year Warranty Period.
    4. Refurbished Products (B-Stock)
      1 year, except for Refurbished VTP and VSP Series products which have a 6-month Warranty Period.
    5. Optional Extended Warranty
      Beginning January 1, 2024, at the time of product purchase, an optional Extended Warranty may also be purchased. The Extended Warranty increases Atlona’s Limited Product Warranty Period to a total of five years (including the original 3-year or 2-year Warranty Period). Customers purchasing the Optional Extended Warranty also receive free advanced replacement for covered products. The Extended Warranty is non-refundable and non-transferable. Some product line exclusions apply.

Exclusions

This Limited Product Warranty is void if the label bearing the serial number of Products have been removed or defaced or if the products are purchased from unauthorized distributors, dealers, resellers, auction websites or similar unauthorized channels of distribution at time of purchase. Before using, Purchaser shall determine the suitability of the Atlona product for his/her intended use and Purchaser assumes all risk and liability whatsoever in connection therewith. In addition, this warranty does not cover any defects resulting from:

    1. Normal wear and tear,
    2. Battery failure,
    3. Misuse or abuse,
    4. Neglect,
    5. Improper storage, packaging, shipping, or handling;
    6. Accidental damage beyond Atlona’s control such as fire, storm, lightning, power surges, water or chemical damage
    7. Unauthorized firmware or interfacing;
    8. Operation outside of the environmental specifications for the products;
    9. Improper or inadequate site preparation, installation or maintenance by Purchaser; or
    10. Any repairs or alterations performed by anyone unauthorized by Atlona to make such repairs.
    11. Pixel burnout and/or image retention

No Warranty for Third-Party Products/Service

Atlona makes no representations and disclaims all warranties of any kind, express or implied relative to any third-party product or service, including any third-party accessories, hardware, software or firmware, which may be incorporated into an Atlona product and/or resold or sublicensed by Atlona. To the extent any warranties extended to Atlona by the third-party manufacturer are transferable, Atlona will transfer such warranties to Purchaser and any enforcement of such third-party warranties shall be between Purchaser and the third-party. Atlona does not warrant the compatibility of Atlona products with the products of other manufacturers or Purchaser’s applications except to the extent expressly represented in Atlona’s published specifications, written quotations or statements of work.

LIMITATION ON LIABILITY

THE MAXIMUM LIABILITY OF ATLONA UNDER THIS LIMITED PRODUCT WARRANTY SHALL NOT EXCEED THE ORIGINAL ATLONA MSRP OF THE DEFECTIVE PRODUCT. TO THE EXTENT PERMITTED BY LAW, THE WARRANTIES PROVIDED HEREIN ARE PURCHASER’S SOLE AND EXCLUSIVE WARRANTIES. ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR USE ARE DISCLAIMED. TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ATLONA BE LIABLE FOR ANY LOSSES OR DAMAGES ARISING FROM ANY ATLONA PRODUCT WHETHER DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR SPECIAL, INCLUDING WITHOUT LIMITATION ANY CLAIM FOR LOSS OF DATA, LOSS OF ACTUAL OR ANTICIPATED REVENUE, PROFITS. IF ANY PRODUCT TO WHICH THIS LIMITED WARRANTY APPLIES IS A “CONSUMER PRODUCT” UNDER THE MAGNUSON-MOSS WARRANTY ACT (15 U.S.C.A. §2301, ET SEQ.) OR OTHER APPLICABLE LAW, THE FOREGOING DISCLAIMER OF IMPLIED WARRANTIES SHALL NOT APPLY, AND ALL IMPLIED WARRANTIES ON ITS PRODUCTS, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR THE PARTICULAR PURPOSE, SHALL APPLY AS PROVIDED UNDER APPLICABLE LAW.

RMA Process

Atlona recommends that end-purchasers contact their authorized Atlona dealer or reseller from whom they purchased their products. Atlona can also be contacted directly. Visit www.atlona.com for Atlona’s contact information and hours of operation. For any defective firmware contained in the Atlona product, Atlona will provide Purchaser with updated firmware only and Purchaser will be solely responsible for its installation. Purchaser-requested onsite warranty service is not covered and will be at Purchaser’s sole expense, unless authorized in writing by Atlona in advance. Atlona has the right to either examine the Atlona product where it is located or, in its sole discretion, issue shipping instructions for return of the Atlona product. Where applicable, Purchaser must return the defective product, part or component, to Atlona’s customer service department accompanied by Atlona’s Return Material Authorization (“RMA”) and/or case number. Atlona reserves the right to reject any products received without an RMA and/or case number. Authorizations can be requested by calling Atlona customer service. If Atlona confirms that there is a defect that is covered by this warranty, the repaired or replaced Atlona product will be warranted for the remainder of the warranty period applicable to the originally shipped Atlona product. If requested by Atlona, Purchaser must provide a dated sales receipt/invoice, including date of purchase, in order to receive warranty coverage.
